Scope of Application

These general terms and conditions (hereinafter referred to as "GTC") of Metzler Mobility (hereinafter referred to as "OLEYVO") apply to all rights and obligations arising from the business relationships between OLEYVO and its customers. By placing an order, the customer acknowledges the GTC applicable at the time of the order as part of the contract. The offer on this website is directed exclusively at customers residing or with a business address in Switzerland or Liechtenstein. Deliveries are made exclusively to addresses in Switzerland or Liechtenstein. These GTC are exclusive. Any opposing, supplementary, or deviating terms and conditions require the explicit written confirmation by OLEYVO to be valid. By using this website or placing an order, the customer fully acknowledges these GTC, including delivery and payment terms. If individual provisions of the contract, including the GTC, are wholly or partially invalid, the validity of the remaining provisions or parts of such provisions remains unaffected. In place of the invalid provision, a provision will apply that comes as close as legally possible to the purpose of the invalid provision. OLEYVO expressly reserves the right to amend these GTC at any time and put them into effect without prior notice.

Information on This Website

Price and assortment changes as well as technical changes are reserved. All offers on this website are non-binding and should not be considered as a binding offer. OLEYVO cannot guarantee the currentness, completeness, or correctness of the data, nor the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is not guaranteed that the use of the website will not infringe third-party rights not owned by OLEYVO.

Prices and Product Information

The price information displayed on www.oleyvo.com is exclusively in Swiss Francs (CHF), including VAT. Additional processing fees and shipping costs are not included. These will be separately charged and indicated during the order process (orders over CHF 1650 come with free shipping). The products and prices in the online shop are offers. However, this offer is always subject to the condition of delivery impossibility or incorrect price information. OLEYVO reserves the right to change prices at any time without prior notice. For the products ordered by customers, the prices valid on the order date and stated on the order confirmation apply. Technical changes, errors, and printing mistakes are reserved. Consultancy and support services are not included in the sale prices.

Conclusion of Contract

Orders become binding as soon as the customer places the order. The order can be made via the online shop, by phone, WhatsApp, in writing, or verbally. OLEYVO’s order confirmation is sent by email. For short-term deliveries, the delivery note/invoice may replace the written confirmation. After receiving the confirmation, the customer can cancel the order within 3 days, provided the order has not yet been delivered. By placing the order, the customer fully and unconditionally accepts these GTC, excluding any other provisions or conditions. OLEYVO reserves the right to refuse any customer order. Orders are only shipped after full payment has been received and if the goods are available. If, after the contract has been concluded, it turns out that the ordered goods cannot or can only be partially delivered, OLEYVO is entitled to withdraw from the entire contract or part of the contract. Claims for delayed delivery or failure of delivery are excluded.

Payment

The customer can choose from the available payment methods in the online shop. Payments must be made in Swiss Francs (CHF). OLEYVO reserves the right to exclude customers from certain payment options without giving reasons or to require prepayment.

Purchase on Account with Installment Option (POWERPAY)
MF Group / POWERPAY offers the payment option “Purchase on Account”. With the individual invoice, you can easily pay for your online purchase via invoice. If you opt out of payment within the specified period, you will receive a monthly invoice with a summary of your order in the following month.
When concluding the purchase contract, POWERPAY assumes the invoiced amount and handles the corresponding payment modalities. When purchasing on account, you also accept the POWERPAY Terms and Conditions in addition to our GTC. (powerpay.ch/de/agb)

Delivery

The customer's delivery address must be easily accessible by truck. If this is not the case, the customer will bear any additional costs. OLEYVO places great importance on providing accurate and up-to-date information on availability and delivery times in the online shop. However, due to production or delivery bottlenecks, delivery delays may occur. All information on availability and delivery time is without guarantee and can change at any time. Delivery dates published in the online shop are based on the current information available to OLEYVO. In no case will delivery delays give rise to claims for compensation or the right to withdraw from the contract.

If the customer does not accept the ordered products on the agreed or indicated delivery date, OLEYVO may terminate the contract and charge the customer for the incurred delivery costs and any potential depreciation in value.

Complaints / Defects

The customer is obligated to immediately check the goods upon receipt of delivery and report any defects or discrepancies from the order. Such complaints must be sent to OLEYVO immediately, but no later than 5 days after delivery, by email or registered mail to the address in the imprint.

Returns

If you change your mind, you can return your unused OLEYVO e-bike within 7 days upon presentation of the purchase receipt. You can return it by mail at your own expense. You will receive a full refund of the purchase price if the product is in perfect condition. If the box is opened and the OLEYVO is unpacked, and signs of use or damage are visible, we reserve the right to issue a partial refund reflecting the reduced value.

The withdrawal period is 7 days from the day you or a third party named by you, who is not the carrier, took possession of the final item. A return handling fee of 40.00 CHF will be charged. In exceptional cases, we may accept used products, but this must be discussed with our customer service. Depending on the condition, restocking fees of up to 1,650.00 CHF may apply. You can then drop off your package at any post office for return shipping at your own cost. Please keep the item in its original packaging and pack it carefully for transport. As a general rule, used, opened, or unsealed items are not eligible for return. If, upon inspection by OLEYVO, the goods are found to be free of defects or not covered by the manufacturer's warranty, OLEYVO reserves the right to charge the customer for handling, return shipping, or potential disposal costs.

Warranty (Guarantee)

Quality is very important to us. If any issues or questions arise regarding your bike, you can contact us at any time.

The warranty is excluded, as far as legally permissible.

The following warranty claims apply only to the first legal owner who acquires ownership through the purchase of the bike from OLEYVO. To make a warranty claim, proof of purchase (via the warranty certificate) must be provided. The warranty claims are non-transferable. OLEYVO grants a 2-year warranty from the date of purchase on material and workmanship defects for a bike marked with OLEYVO. OLEYVO will, at its discretion, either replace the defective product with a similar product of equal quality or repair it. The right to withdraw or diminish is excluded. Wear parts like tires, tubes, chains, brake pads, shift/brake cables and housings, lighting systems, grips, cassettes, chainrings, etc., and parts altered by the buyer or damaged due to improper handling, accidents, or lack of maintenance are excluded from the warranty.

Liability

OLEYVO excludes any liability, regardless of its legal basis, as well as claims for damages against OLEYVO and any auxiliary persons or agents. OLEYVO is particularly not liable for direct or indirect damages, consequential damages, loss of profit, or other personal, property, and pure financial damages of the customer. Further mandatory legal liability, such as for gross negligence or intentional wrongdoing, remains reserved. OLEYVO does not provide any warranty for damages caused by improper handling or assembly.

Data Protection

For the processing of personal data by OLEYVO, the Federal Data Protection Act applies. See the Data Protection section for more information.

Applicable Law and Jurisdiction

Swiss law exclusively applies, with the express exclusion of the Swiss Federal Act on Private International Law (IPRG) and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
